FT.com / World / US & Canada - Court orders release of Guantánamo Uighurs: "A US court has ordered the immediate release of 17 Chinese Uighurs who have been imprisoned at Guantánamo Bay since 2002, in a landmark decision that deals another blow to the Bush administration’s detainee policy.

In the first court ruling to release prisoners from Guan-tánamo, Judge Richard Urbina said the Uighurs – Muslim Chinese from north-western Xinjiang province – posed no security risk to the US. He said the US constitution did not allow the Pentagon to hold the men indefinitely.

The Uighurs were captured in 2002 after they fled a camp in Afghanistan following the US invasion. The Pentagon cleared the men for release in 2004 after determining they were no longer “enemy combatants”. The US has refused to repatriate them to China because of concern they could be persecuted.

Washington has tried unsuccessfully for years to persuade other countries to accept the Uighurs. The Bush administration argues that they cannot be brought to the US because of anti-terrorism laws. "
